  1. תנאי שימוש – כללי
אתר אינטרנט זה מופעל על-ידי עגול שיווק ומדיה בע"מ (להלן:"החברה" או "מפעילת האתר"). ניתן לפנות אל החברה לפי הפרטים המצורפים בסוף תנאי השימוש. עליכם לקרוא תנאים אלה היטב, שכן כל שימוש באתר, גלישה בו, צפייה או שימוש בתכנים מעידה על הסכמתכם ואישורכם את האמור בתנאי שימוש אלו. אם אינכם מסכימים עם אחת מתניות ההסכם, אין לכם רשות לגלוש באתר זה או לעשות בו כל שימוש, לרבות שימוש במידע שבו. תנאי שימוש אלה מהווים חוזה בינך לבין החברה, על כל תנאיו, סעיפיו והקישורים שבו. כל שימוש באתר, בתכנים המוצגים בו ובקוד האתר כפוף לתנאי השימוש שלהלן, לרבות שימוש מרחוק באמצעות טכנולוגיית עזר, לרבות גלישה סלולרית, RSS או כל אמצעי טכנולוגי אחר.

  1. בתנאי שימוש אלו, למונחים הבאים תהיה המשמעות המצוינת:
"תכנים" – כל תוכן המופיע באתר או המרכיב את האתר, לרבות טקסט, תמונה, אנימציה, קוד מקור, עיצוב, אלמנטים גרפיים, רכיבים אינטראקטיביים; "גולש" – כל גולש לאתר, בין אם הגולש גולש באתר בעצמו או באמצעות אחר, לרבות אדם או חברה או כל ישות המפעילים רכיב טכנולוגי הגולש באתר מטעמם או עבורם;
  1. שימוש באתר
השימוש באתר מוצע לגולש בכפוף להסכמתו לכל האמור בתנאי השימוש. האתר מוצע לך, הגולש, כפי שהוא (AS-IS), וכפוף לשינויים לפי שיקול דעתה הבלעדי של החברה, מעת לעת וללא הודעה מראש. אתר זה נועד עבור שימוש אישי-לא מסחרי (personal non-commercial) בלבד. נאסר לחלוטין כל שימוש מסחרי באתר, בתכניו, או בכל רכיב שלו. איסור זה חל גם על שימוש בכל אמצעי טכנולוגי עבור שימוש שאינו אישי או שימוש מסחרי, לרבות אמצעים טכנולוגיים כלשהם. המידע באתר אינו מהווה יעוץ רפואי, משפטי, כלכלי או כל יעוץ אחר ונועד להרחבת הידע האישי בלבד. בכל שאלה יש להתייעץ עם איש מקצוע מומחה. מובהר בזאת כי אין להסתמך על המידע באתר זה לביצוע כל פעולה. במידה ובאתר זה מותקן מחשבון לצורך ביצוע חישובים מכל סוג ומין יובהר ויודגש כי כל זכויות היוצרים מכל מין וסוג בתוכנה ו/או בקוד המקור שלה שייכים לבעל המחשבון בלבד, ובהתאם אין להעתיק ו/או להטמיע ו/או לעשות כל שימוש מכל סוג ומין במחשבון. למרות האמור לעיל בעל הזכויות נותן רישיון שימוש אישי שאינו מסחרי וזאת לשימוש אך ורק במסגרת האתר. על מנת להסיר ספק יצויין, כי כל שימוש שאינו מותר יגרור הגשת תביעה לבית המשפט המוסמך, זאת, בגין הפרת זכויות יוצרים ורישיון השימוש.

למעט היכן שיצוין אחרת, בכל הקשור באתר כל הזכויות שמורות לחברה. הזכויות שמורות בכל הקשור אל כל רכבי האתר, לרבות כותרות, טקסטים, מוסיקה, מנגינה, רכבי אודיו ואפקטים, תמונות (מלבד תמונות אשר זכויות היוצרים בהן שייכות לגורמים אחרים), גרפיקה, עימוד, אלמנטים עיצובים, קישורים וקוד המקור. נאסר במפורש להעתיק כל חלק שהוא מן האתר לכל מטרה שהיא ובכל צורה שהיא, טכנולוגית ואחרת. איסור זה כולל איסור על העתקת כותרות, טקסטים, מוסיקה, מנגינה, רכבי אודיו ואפקטים, תמונות, גרפיקה, עימוד, אלמנטים עיצובים, קישורים וקוד המקור. חל איסור מפורש על שימוש ברובוטים או כל אמצעי אחר, טכנולוגי ושאינו טכנולוגי, על מנת להעתיק, לסרוק, או לייצר עותק חלקי או שלם של המידע המופיע באתר. חל איסור מפורש לבצע בתוכן או בכל חלק מהאתר כל סילוף, פגימה או שינוי אחר, או כל פעולה שיש בה משום הפחתת ערך ביחס לתוכן המוגן לרבות הצגת כל חלק מהתוכן במסגור בכל הקשור בשימוש מסחרי בתכנים הנמצאים באתר, לרבות בכתבות המלאות באתר, ניתן לפנות אל החברה בפניה לרכישת רישיון מסחרי עבורם. פרטי ההתקשרות מופיעים בסוף תנאי השימוש. רשיון שימוש בתוכן: ניתן לרכוש רישיון שימוש בתוכן הנמצא באתר כדלקמן: רשיון שימוש לא בלעדי למאמר תוכן – 3,100 ₪ רשיון שימוש לא בלעדי למאמר תוכן הנמצא בעמוד הראשון של גוגל עבור מילת מפתח אחת לפחות – 8,300 ₪ רכישת זכויות יוצרים עבור מאמר תוכן הנמצא בעמוד הראשון של גוגל עבור מילת מפתח אחת לפחות – 13,400 ₪ המחירים אינם כוללים מע"מ כחוק
  1. שימוש ב-RSS
טכנולוגיית ה-RSS מאפשרת לחברה לשלוח אל המנויים על זרם ה-RSS של האתר את כותרות המאמרים ואת תוכנם, או כל חלק מהם. זרם ה-RSS של האתר נועד גם הוא לשימוש פרטי-לא-מסחרי בלבד. על אף האמור, ניתן בזאת רישיון מסחרי זמני להציג כותרות המאמרים המוצגים באתר בתוספת שלושת המשפטים הראשונים, והם בלבד, בשימוש מסחרי, תחת התנאים הבאים: א. לא נגבה כסף בצורה ישירה או עקיפה עבור גישה אל התכנים הנלקחים מהאתר; ב. ניתן קישור בגוף האתר שבו מופיעים הכותרת ושלושת המשפטים חזרה אל אתר החברה. כמו כן, חובה על טקסט העוגן (Anchor text) להיות "הכתבה מפורסמת במלואה באתר _______", וטקסט זה בלבד. מעבר לכך, על גודל הגופן המפנה חזרה לאתר החברה להיות באותו גודל בו מופיעה הכותרת או שלושת המשפטים, או הגדול מביניהם. גופן טקסט העוגן יהיה בצבע ככל הקישורים באותו עמוד בו הוא מוצג, או שיופיע בצבע הבולט בצורה משמעותית מהרקע שלו, לפי הבולט מביניהם; ג. חל איסור על אכסון הכותרות והמשפטים מאתר החברה בצורה שאינה מקוונת (off-line) בכל טכנולוגיה שהיא, לרבות כל טכנולוגיה וצורת ארכיב; ד. שימוש בכותרות ובשלושת המשפטים הראשונים יכול שיהיה אך ורק בצורה מקוונת הזמינה לקהל הרחב ללא כל הגבלה, וחל איסור על שימושם בכל מקום או מתחם הדורש שם משתמש או שם משתמש וסיסמא על מנת להיכנס; ה. החברה שומרת לעצמה את הזכות לשלול רישיון זה בכל שלב וללא הודעה מראש. מעבר לזה, החברה גם שומרת על זכותה להתחיל בכל שלב לגבות כסף עבור רישיון מסחרי זה וללא הודעה מראש; ו. נוסחו המעודכן ביותר של רישיון מסחרי זה הוא הקובע, והוא בלבד. תוקפו חל רטרואקטיבית, ובכל מקרה בעתיד בו תבחר החברה לשלול את פרסום המידע שלה באתר או באתרים אחרים, מסכים כל מי שבוחר להשתמש ברישיון זה כי יפעל בכפוף להנחיות הנוסח העדכני, לרבות מחיקת תכנים של החברה שפורסמו בעבר באתר או באתרים מסחריים אחרים. כמו כן, הוא מתחייב לפעול תוך שיתוף פעולה מלא ובצורה מיטבית על מנת להסיר את התכנים מהאתר או האתרים שאליהם העתיק את החומרים המוגנים של החברה, גם אם אלה אינם נמצאים עוד תחת שליטתו;
  1. קישורים ואתרים של צדדים שלישיים
הקישורים המובאים באתר אל אתרים של צדדים שלישיים מובאים לידיעה בלבד, וכמו שהם. אין לחברה כל אחריות לגבי כל אתר של כל צד שלישי. כמו כן, אין כל אחריות כי האתרים האחרים זמינים או מאובטחים כנדרש. גולש אשר בוחר לעבור דרך הקישורים באתר לאתרים של צדדים שלישיים עושה זאת על אחריות בלבד, והוא מוסכים ומודיע מראש כי אין לו ולא יהיו לו כל טענות כלפי החברה.

  1. מידע אישי
במסגרת הגלישה באינטרנט, מועברים בצורה אוטומטית פרטי מידע בין שרתי האינטרנט ולבין המחשב בו משתמש הגולש. פרטים אלה לרוב אינם מזהים אישית, וכוללים מידע על מערכת ההפעלה, באיזה דפדפן מנסים ליצור קשר עם השרתים, ומהי שפת המשתמש. נתונים אלה ונתונים נוספים המועברים אוטומטית, מועברים כחלק מהתקשורת האוטומטית שמטרתה להעביר את המידע בצורה הנכונה והמיטבית משרתי האכסון של אתר האינטרנט עד למחשב של הגולש. מידע זה אינו נשמר באופן סדיר על ידי החברה, אך החברה שומרת על זכותה לעשות שימוש במידע זה לצרכים סטטיסטיים ולשמור את המידע הסטטיסטי בהתאם לצרכיה. החברה שומרת לעצמה את הזכות לשתף את המידע הזה עם גורמים שלישיים, לפי שיקול דעתה הבלעדי. כמו כן, שומרת לעצמה החברה את הזכות לשמור עותק ו/או גיבוי של המידע הסטטיסטי, לפי שיקול דעתה הבלעדי מידע אישי, ככל שיימסר על ידי הגולש אל החברה, מוסדר ומפורט במדיניות הפרטיות, המהווה חלק בלתי-נפרד מתנאי שימוש אלו.
  1. אבטחה
החברה נוקטת באמצעים מקובלים לשמירה על אבטחת מערכותיה. הגולש מסכים ומצהיר כי אין לו ולא תהיה לו כל טענה כלפי החברה בכל מקרה בו נפגעה אבטחת האתר, או כל חלק בו. כמו כן, הגולש מצהיר ומתחייב כי לא יעשה כל שימוש שיפגע באבטחה או בשלמות מערכותיה של החברה, לרבות העמסה או הכבדה על שרתי החברה בכל צורה שהיא.
  1. תניית שיפוט בלעדית
מובהר בזאת כי הגולש מצהיר ומסכים כי בכל מקרה של סכסוך בינו לבין החברה או מי מנציגיה, עובדיה, או מי מטעמם, תהיה סמכות בלעדית לבית המשפט המוסמך במחוז תל אביב  ולו בלבד. כל התדיינות משפטית או אחרת תהיה בפני בית המשפט המוסמך, כאמור לעיל.
  1. אחריות
הגולש מצהיר ומסכים לדברים הבאים: א. הוא קרא, הבין, והסכים עם כל האמור בתנאי שימוש אלה, על כל סעיפיהם, נספחיהם וקישוריהם. ב. מובהר בזאת כי האמור באתר אינו ייעוץ רפואי, אינו ייעוץ מקצועי ואינו מהווה תחליף לייעוץ מקצועי בכל נושא שהוא. יש להתייעץ עם מומחה בכל תחום מבוקש, ולא להסתמך על האמור באתר. ג. העצות והדעות המובאות אינן בהכרח מייצגות את דעת החברה; ד. הגם שהחברה פועלת שהמידע שמופיע באתר יהיה מדויק ומושלם, ייתכנו טעויות באמור באתר. הגולש מבהיר בזאת כי אין לו כל טענות כנגד החברה בגין טעויות או מידע שגוי או מידע שאינו מעודכן שהופיע באתר. מדיניות פרטיות

מדיניות הפרטיות של האתר המפורטת כאן, מהווה חלק בלתי-נפרד מתנאי שימוש אלו. שימו לב כי באחריותכם לבדוק ולוודא מראש את תנאי השימוש ואת מדיניות הפרטיות, כתנאי לכל שימוש באתר. נוסחה המעודכן הוא הקובע, והיא עשויה להשתנות מעת לעת, לפי שיקול דעתה הבלעדי של החברה, וללא הודעה מראש. הגולש מצהיר ומסכים לפעול ולהתנהג בהתאם לאמור בתנאי שימוש אלו ובמדיניות פרטיות זו.
  1. אתרי צד שלישי ומשואות רשת
במסגרת פעולתו התקינה של האתר, ייתכנו בו רכיבים המגיעים מצדדים שלישיים. רכיבים אלה יכולים להיות אלמנטים בולטים או משואות רשת (Web Beacons). מובהר ומודגש בזאת כי במסגרת עבודתו התקינה של האתר, בכל משיכה כזאת של מידע מאתרים של צדדים שלישיים מועבר מידע אוטומטית בין הדפדפן של הגולש לאתר של הצד השלישי. מידע אוטומטי זה אינו כולל מידע מזהה אישי, וכולל את הנתונים האוטומטיים העוברים דרך פרוטוקול התקשורת של האינטרנט. מידע זה מועבר אוטומטית, ואין לחברה או לאתר כל אחריות לגביו או לכל שימוש בו על-ידי צדדים שלישיים. הגם שמידע זה עובר עצמאית דרך הגולש, ייתכנו מצבים בהם המידע עובר אוטומטית גם דרך שרתי החברה, במסגרת פעולת גלישה תקינה. גם לגבי מידע זה אין ולא תהיה לחברה או לאתר כל אחריות לגביו או לכל שימוש בו על-ידי צדדים שלישיים.
  1. עוגיות
